Initial Discovery Phase (Phase One)

Language:

Service Overview

Phase One is a fixed-scope discovery and advisory service focused on reviewing the client's existing systems, workflows, tools, and operational structure. The purpose of this phase is to gain clarity on how the business currently operates, identify gaps or inefficiencies, and provide strategic direction and recommendations.

Phase One is designed to support informed decision-making and does not include implementation.

Scope of Work

Phase One is strategic and advisory in nature. Unless explicitly agreed in writing, Phase One does not include:

  • System or tool implementation
  • Workspace or database setup
  • Automation configuration
  • SOP creation or documentation build-out
  • Ongoing support or execution

Any work outside the scope of Phase One requires a separate agreement.

Deliverables

Phase One includes:

  • A written summary of findings and recommendations (PDF, Notion, or similar format)
  • A high-level systems and workflow map outlining how your operations should be structured
  • One live review or walkthrough call to explain findings and answer questions

Consultant Responsibilities

I agree to:

  • Review all materials and information provided by the client with reasonable care and professionalism
  • Provide recommendations based on experience, best practices, and the information available at the time
  • Communicate clearly regarding scope, timelines, and next steps

Client Responsibilities

The client agrees to:

  • Provide accurate and complete information during onboarding
  • Grant access to relevant tools, documents, or systems as requested
  • Respond to onboarding questions and follow-up requests within 3–5 business days

The 3–5 business day window is a preferred response time to keep things moving efficiently. Work won't be immediately cancelled over a delayed reply, but if the Client remains unresponsive for more than 14 consecutive days, the Consultant reserves the right to close the Phase One project and deliver the final summary based on the information available at that time. Re-opening a closed project may incur an additional fee.

Timeline

Phase One begins on the date onboarding materials are sent to the client. The process typically takes 1–2 weeks from the start of onboarding and concludes with the final review / clarity call, which marks formal completion of the service.

Timelines are estimates and may vary based on:

  • Client responsiveness
  • Complexity of existing systems
  • Scheduling availability
  • Unforeseen circumstances or force majeure

Timelines are not guaranteed.

Payment & Refund Policy

  • Full payment is required to reserve a Phase One slot.
  • Payments are fully refundable within 24 hours of purchase, provided work has not begun.

After 24 hours:

  • If onboarding has not been completed and no work has begun, a partial refund of up to 50% may be issued at the consultant's discretion.

Once work has begun:

  • Payments are non-refundable.

In the event of a chargeback or payment dispute initiated by the client after work has commenced, the consultant reserves the right to withhold all deliverables until the matter is resolved.

Intellectual Property, Marketing & Confidentiality

All strategic recommendations, documents, and materials delivered as part of Phase One are created for the Client's use. The Consultant retains the right to use the Client's name, logo, general project descriptions, testimonials, and anonymised learnings for marketing, portfolio, and case studies, unless the Client requests otherwise in writing.

Sensitive internal data remains strictly confidential, including (but not limited to) client lists and contacts, financial records and pricing, proprietary processes or SOPs, internal communications, login credentials, and anything the Client marks as confidential. These confidentiality obligations apply to both parties and remain in effect indefinitely, surviving the end of the engagement.

If the Client wishes to remain anonymous in any public materials, they may notify the Consultant in writing at any time before the conclusion of Phase One.

Exceptional Circumstances

  • If the service cannot be delivered due to consultant illness or force majeure, a prorated refund will be issued for any work not completed.
  • In rare cases where expectations are found to be clearly misaligned prior to meaningful work being delivered, a partial refund (up to 25%) may be issued at the consultant's discretion.

Confidentiality, Data & AI Tools (GDPR)

All business information and system structures shared are strictly confidential and handled according to GDPR standards. I only collect the minimum data necessary to perform the service and will never share it with third parties.

I use AI-assisted tools to support the delivery of this service, including organising and summarising information you share with me. Your data is processed confidentially, is not shared with third parties, and is not used to train AI models. By engaging my services, you consent to this use of AI tools as part of my workflow.

If tool access is granted, it is the client's responsibility to revoke it once the work is complete, though they may do so at any time.

Nature of Service & Liability

Phase One is an advisory service focused on systems design, operational clarity, and tools within the consultant's expertise (Notion, Zapier, workflow structuring, and operational systems). The client is responsible for assessing fit, making implementation decisions, and all resulting business outcomes. No specific results are guaranteed.

The consultant is not an executive decision-maker, business coach, or COO. To the maximum extent permitted by law, liability is limited to the amount paid for Phase One.

Phase Two & Implementation

Phase Two implementation is a separate agreement. Completion of Phase One does not obligate either party to proceed to Phase Two, ensuring that a high standard of professional alignment is maintained for full builds.

Both the Consultant and the Client reserve the right to decline moving forward into Phase Two for any reason. Completion of Phase One does not guarantee an offer for implementation services, and Phase Two services are governed by their own separate agreement and are not covered under these terms.

Governing Law

These terms are governed by the laws of Spain. Any disputes will be handled under Spanish jurisdiction unless otherwise agreed in writing.

Acceptance of Terms

By completing payment for Phase One, the client agrees to these terms and conditions.
